I’ll think you’ll find the AFL were claiming rights they didn’t have among rights they did- As such we sought legal advice and refused to change a lot of the alleged ‘offending material’ the AFL accepted that.

Surely the AFL has the right to protect its own “intellectual property” if some people dont know what that is then thats not the AFL’s problem … ignorance is no legal defense.

Well actually, the AFL haven’t said that they can’t use the names of the clubs or AFL, they said they can’t use images with players or logos or the likes. In fact Patrick Keane in the article says it is fine to use them in editoral content.

One of the big issues with the site was the use of AFL players in AFL jumpers in the logo, possibly the name of the site (“AFL Blog”. Confusion with official site) and the use of images.

Now the real issue (to me) is if they can stop us using photos of AFL players if we have the Photographers permission. The photos are mainly what I would call “User Generated” Photos. I.E. If I take photos of a player, can I use it on my site no matter if it is commercial or not.

I would love to hear from a Lawyer on this one!

Wow this is some seriously dumb decisions by the AFL. Of course they need to protect their copyright but on the otherhand don’t they want some publicity too. This isn’t Channel 9 stealing broadcast images and impinging on Ten’s paid ofr broadcast rights to support million dollar ad revenues. A majority of blogs (just like this one) are really just fan sites and communities.
